I was the inventory manager at a small warehouse. I just got a call today becuase I was fired. I turned a guy in for stealing a week ago. Well they caught him last night and canned him. Then fired me today for turning him in. He was the head managers little teachers pet, and the head manager pleaded with the owner to keep the guy, even thou he got caught with stolen stuff in his car. So the head manager got mad for me turnning him in to the owner, and he fired me. HAHAHAHA. I never heard of such crazy shit.
Merry Xmas to me. |

Just my 2 cents.....contracts even legal ones most of the time don't hold up in court. I understand the right to fire someone for any reason my company has a similar policy but the law is on your side. My wife happens to work in such a field and according to her you can take them to court. I would get a lawyer...man right before the holidays, who do you work for the grinch.

yeah i agree... i took business law as part of my degree(dunno if the laws applies to america as well) mostly concerned in contractual agreements and employment contracts. when u wer hired, you would mostly likely have signed a contract with them? read over the terms of it if you can access it...
here if the contract even said that they can fire you for no reason, there is a parent legislation (ACT) that said nope, cant do that, need a valid reason for dismissal... and in your case its a unfair dismissal.. im sure lawyers could get you a couple of thousand in your bank ![]() i could have fired those high school slackers off for playing vid games while on the clock, but meh said to myself its christmas and they need da money.... AND I NEED HELP! lol.. |

It would depend on who has the burden of proof ?
I would expect the company to defend by saying dismissal for cause. Late for work, unreliable, slow, inaccurate, bad attitude, taking too long for breaks, not fulfilling the required duties. "Yes, he caught the thief, but his/her work was so substandard the wages were a bigger loss than the stolen goods, we want BOTH of them gone" Now does the company need to show proof of that cause? or does the plaintiff need to show that the cause was untrue? That would depend on the labor laws in that jurisdiction. |

i am sorry for your lose random.
retribution is a quick and easy solution. but you guys have to think. sue for what? so he can get his job back at a place where he has a crook for boss? or sue for compensation so that he can say "i am sitting on my ass with a small amount of money (settlement minus the lawyer fee not to mention time spent) because I was *honest*". Come to think of it, it's better for him to just take this as a blessing in disguise and seek employment opportunities else where that would better suit him. |

I agree with Masahiro here.
Litigation with your previous employer is seldom a winner when a prospective employer performs a background check, makes the next job desperately hard to get whether you win or lose. So unless you are suing for loss of career - enough money to retire on, it is probably not worth it. |
