Ex Parte Ayers, 123 US. 443, (1888 .....)
"A state, without its consent, cannot be sued by an individual, and a court cannot substitute its own discretion for that of executive officers in matters belonging to the proper jurisdiciton of the latter...." "If it appears that I consented I have never consented and I do not consent now." Seems like a simple enough approach. Place yourself in the role of the state (shouldn't be a far journey) and start acting as if your consent MATTERS. |
