Default What do you guys think about how the police took care of this?
Heres the story...

a month ago a kid on my childs bus .. my child is 12 this kid is 16... choked my kid until he nearly blacked out.. there was bruising on my kids neck so I called the police and filed a report against the kid.. the cops investigated it and found out the 16 year old was on probation so they took him to jail. Today my kid gets home from school and tells me that he went to court and testified against the kid that choked him... WTF???? Why wasnt I contacted? Is this legal? My kid said he had a lawyer there n everything? I KNEW NOTHING ABOUT IT AT ALL.. I know my child was with the police and he was in good hands but this is not ok with me. What should I do if anything at all? What would you do?

I think in retrospect there is nothing you can do. If you file a complaint now, the kid who chocked your child will likely walk on a technicality over "testimony under duress".

Sounds very dodgy to me!

What about the mother or a teacher or someone from the school? How did your kid get to the court? Someone must have known it was going to happen and should have contacted you!

No one contacted me.. The police went to school and took my kid and another kid to court and then back to school. I knew nothing!!!

being that children cant go on a field trip without parent permission, I dont see how they could remove your child from school to go to court. technically I dont think he could give testimony without your permission either. If it was my kid I would have wanted to be there. But as said if you complain about it at this point the other kid will likely walk or have to have a retrial. Seems like something shady went on with the whole situation in all honesty.

best you could hope for at this point would be to contact the school for information about how this all took place without your knowledge, but not do so in a hostile manner as to not cause any possible interruption with whatever sentence the other kid will get

I just aint sure what to do. Im glad that kid wont be allowed on the bus or around my child anymore but...... this seems illegal to me... I know if I do something illegal they will have my ass!! why should they be allowed to break the law? or did they? does a judge have the right to have my child removed from school without my permission?

I agree, it is outrageous that they took your 12 year old child to court without telling you!
But maybe they had asked the principal at your school? You should start by giving the school a bollocking for allowing them to take your child without contacting you.

No, absolutely not. You cant enter a minor into a legal proceeding without the consent (or even presence, i think) of their parental guardian. unfortunately i couldn't advise you on how to proceed. very bizarre occurance though

Was this an actual court, or more of a school district hearing where the district heard the evidence of the case for possible expulsion of the offender?

As to contacting an attorney, tap the breaks. While this (if he was taken to an actual court of law) is certainly something to throw a fit about, there is no damage done to you (and i think it tough to make a case damage was done to your child)... thus, there is really no need to lawyer up, as an apology is the best you can hope for lawyer or no lawyer. Just throw the fit and get an apology, it will be cheaper.

So lets say the father of the 16 yr old kid, turns up at the school dressed as a cop, takes your kid away saying he's taking him to court etc to testify against the 16 yr old, The father then takes him somewhere, murders him and the first thing you know about it, is when the school phone you up and say your child has not come back to school after some cop turned up to take him to court.

I'd be pretty f*cking pi$$ed off if that was my kid and I wasn't told what was happening.

Seriously, I'd sue their a$$es!

In my opinion, you are well within your right to sue their asses.. whether or not you would be successful is another case.

But look at it this way, they make you sign permission slips to take your child off school campus.. out of school ect... for a reason. You were given no notice? Your child was taken without permission? Sounds like you have a case to me.

they can certainly come and arrest them at school without your consent, and then take them straight to the police station without a permission slip from you, so yeah, I am pretty sure it is still america. However, if it was a true court case, and not some type of inter school district hearing that has nothing to do with law, I am confused how you or your son were not notified in advance.

all i can think is that, if it wasn't some type of inner school thing, that a judge was hearing a case about his (the perps) probation and decided in court she wanted an account of the choking victim, and ordered OP's son outta school. A judge can do stuff like that pretty much at their whim. I think this is a highly unlikely possibility though. If this was not some type of spur of the moment decision, then there is no reason you were not notified, and someone just didn't do their job. Something that is certainly worth bitching about.

Teachers would certainly know about requiring parental consent. Probably even the head teacher in this particular case would be involved. Are you sure you didnt sign anything in a form?
