Default Any Lawyers Out There?
Had a bit of a problem with a nomadic mulignan this afternoon...I was in my back yard when my dog perked up looking up the driveway. I walked towards him telling him to stay and he dashes...some guy was walking out front on the sidewalk and started running across the street. I yelled to my dog to stop, which he did, but the guy slipped in the street and fell. Being a street savvy mulignan, he knew to stay down and act injured until a car stopped and assisted him...he made it to his feet and is talking to the man who stopped. I put my dog in the house and peered out the window to see this guy calling the cops with the guy who stopped. The guy appears to be fine but I am guessing he is gonna try and collect a free lunch off of this fall, so I stayed in the house. A firetruck arrives and checks out the guy and then they leave as soon as the cop got there. They were not very concerned as the guy looks fine. So then the cop knocks, but leaves after a couple minute and the guy goes on his way, I am assuming. Afterwards i talked to my neighbor who was questioned and he said the guy lied to the cop and said my dog tackled him.

So...the question I have for any legal folk out there is...what is my liability for my dog simply scaring the guy into running, and him tripping in the middle of the street, off of my property? Would I be liable at all?

Thanks....I am assuming this guy wasnt hurt much, because the medics left almost instantly and he was up walking fine, just concerned the crafty urban fella might try and fake a head injury or something...

If the cops come, don't atlk to them. instead give them a notarized notice of cease and desist and then tell them strawman fictionalize some jibber jabber 1 fish 2 fish red fish blue fish.

Naw, I wouldn't worry about it, nobody told the guy to take off running, and if he can't run without tripping that's not your problem. Prove that my dog made you run ! No Worries.

If it is a scam, he might fabricate witnesses. This is the kind of risk we all face. If you have something- anything... the scumbags and government will try to take it. Times like these are when you need to be tight with some neighbors.

The first time you told your dog to stay it took off but the second time you told it to stop it listened?

Being an ex paper boy many years ago, I get very displeased when people that can't keep there dogs under control...

You must not be a dog owner...especiall;y a guard dog/pit which was rescued(likely from the same type of scumbag that was walking out front, in the wrong neighborhood)...he bowed up and I told him to stay, then he dashed and when I came out with my loud commanding voice the dog stopped...my dog is trained perfectly, in fact, this is exactly what I have him for

Edit: not to mention my dog never made it within 30 feet of the sidewalk, he was still halfway out my drive...in hindsight, it would be nice if I live in a world where I could simply go and squash it and see if he was OK, but my instincts turned out to be correct. I called the cops to ask if there was a report filed on my residence after coming home to a note on my porch telling me to call the guy(he wanted to "settle it" and when I told him to fuck off, he said that he would try to handle it with a lawyer)...the piece of shit was after exactly what i thought..he lied to the cops and said the dog tackled and bit him...the report from the medics and cops verified that no bite was evident....this is what you can expect in a city like Milwaukee or any other large metropolis....

Ask for supporting evidence if you're pulled into court. His word VS yours and your neighbor who can vouch for how well trained your dog is.

Edit: Of course this is all IF you get pulled into court. Advise the police they need to speak with your lawyer regarding this matter if they return.

Odds are you've already wasted too much time thinking about this.

thanks for the responses all...it seems a closed issue now, as the cop was actually a decent guy on the phone and seemed to be all to familiar with these types of bogus claims here in milwaukee...he advised not to give the guy a cent as he is obviously trying to get a freebie since there was no damages...

I wouldn't have called the cops for sheeet because that proves you had some involment in the matter.

There are no shortage of lawyers that could twist that situation on its face.


I literallty had a tenant break a ankle coming down some back stairs...he was clumsy

make a long story short I get contacted by a laywer. with the regular spiel ....I deny everything and demand he produce all medical records associated with the incident.

nothing ever came of it

respond to nothing unless it comes certifeid

deny everything


last but not least......this is reason why you own gold and silver. it is beyond the reach of every scumbag out their

Now it sounds like the guy tripped himself. Get a copy of the police report he filed, if you can. That should say that he was checked out and had no apparent wounds. Also, did your neighbor see the guy fall? It would help a lot to have a human witness.

There is no crime here, unless the police charge this clown with filing a false report. It's strictly a civil matter.
