German court rules in favour of fat man in a Merc
BERLIN (Reuters) - A German court has ruled that Mercedes must release a man from a car lease deal after a dispute over whether he was too heavy to drive the luxury vehicle, Bild newspaper reported on Tuesday. Mercedes refused to release the insurance salesman from a lease agreement on his S-320 CDI model, arguing the multiple car breakdowns caused by his weight were insufficient grounds to break the deal. But the Stuttgart court ruled in favour of the salesman, named only as Frank S., apparently on the grounds that the car should have been able to take his weight. Frank S. was told that at 160 kg (352 pounds) he weighed twice as much as the average driver, Bild said. "They told me that I was too fat for the car because the seat was broken," he told Bild, in a story next to a picture of the east German squeezing behind the steering wheel of the model Bild said was worth 65,000 euros (44,400 pounds). "I could hardly fit behind the steering wheel ... Then I had to take the car back to the shop for repairs 13 times for 21 different malfunctions in the first 20,000 km." The 37-year-old said he got fed up and wanted to return the car but Mercedes refused to release him from his lease contract. A court in Stuttgart ruled that DaimlerChrysler had to let him out of the agreement. The salesman, who switched to a Volkswagen, would sue to get back the leasing payments he made, Bild said ![]() |

Great yet another overweight person arguing for compensation because some aspect of the world most people live in doesn't adapt to their lifestyle. While I understand that obesity can be caused by medical conditions on some people; for the overwhelming majority of folks it is the result of overeating and/or inactivity. If this guy was so big that he had to squeeze behind the steering wheel, what would he have done if he had gotten in an accident and the airbags deplyed? sue because they werent designed around his size? Give me a break!
BTW, I just lost 30 pounds on the south becah diet. Yoohoo! |

I'm a merc fan but I don't know wich side to choose. I think MB could have worked out the issues away from court so I'm against MB for that. But if you have issues fitting("squeezing") into a car then I'm sorry but it's not MB's fault for it.
SV, I don't see how a front seat should hold 350 pounds, rear seats then yes. I think it's a danger to have a person with that size up in front. |

Why didn't he just take the car for a test drive before he got into a leasing agreement? Surely an MPV/Minivan type of vehicle might have suited him better.

![]() The South Beach Diet is a dietary plan similar to Atkins and the zone. It basically works by shoking you body into ketosis, by eliminating all sugar and most carbohydrates from you system for a period of about 2 weeks, and then slowly reintroducing them along with a more balanced way to eat over a period of time. At the begining you loose large amounts of weight rapidly and then your body begins to level out. The end result, when coupled with esxcercise, is a leaner body and a much more balanced diet (with a much more heavy emphasis on vegetables, lean protein, dietary fiber, and PORTION CONTROL) focused on you preparing your meals and controlling ingredients, which you continue to use on an ongoing basis. It's basically intended to teach you how to eat properly and good dietary habits. Unlike atkins, once you have graduated to phase 3, you are allowed regular "bad" foods, so long as you practice moderation. IN other words, if you order pizza, eat a slice, not the whole pie. |

I thought the same thing...you'd be suprised how easy it really is if you have enough of the right foods in your house...just find foods that you like that have minimal carbs and whatnot and you're good to go...First 2 weeks on south beach I lost 20 lbs...in 3 months I lost 70 lbs... |

Read again, it wasn't that the car couldn't hold his weight, it was that the seat couldn't hold his weight, which is perfectly understandable. the article never elaborates as to what the problems he had , if any, beyond the seat were. |
