Good the whole case is stupid anyways. The judge should just throw out the claims Look at it this way lets say you designed a piece of technology that made every Ford go 10 more miles to the Gallon, you patented the technology and you sold it as an add on for several years then one day Ford comes along they take that patented technology and put it every single one of their cars destroying your business. Wouldn't you think you had a claim against Ford. Or do intellectual property rights not apply to corporations? |

If that was legal then I dont see a problem with it. If I were Ford/Microsoft/whoever I would do the same thing. Unless its not legal of course. But I dont have a problem with what Microsoft did. And why should the customer pay extra for stuff that should be in the program/car/whatever in the first place?
And if I invented something that one of the big ones would want, I'd try to sell it as fast as possible to them as long as the patent rights still lie with me and BEFORE they have the time to steal it. If third party vendors make/invent something that would make sense as an integral part of the original software (PDF converter in Word for example) then the developer of that software should have the right to use a good idea and implement it. Of course they shouldnt steal it, but pay for it. This reminds me about the movie that was about the windshieldwiper guy. Fighting the big ones is all well and good, but you should make sure you have a good chance of winning. |
