Default UK Law help, out of date products.
My brother brought some tobacco from online and they said it was fresh and top quality tobacco.

He ordered a few boxes of Drum, but there was a 3 week delay in him getting the products, he contacted them and they only just shipped it after he contacted them again, he got the tobacco a little over a month after he ordered and opened the box to some other tobacco that was not Drum, on top of that the tobacco was out of date in 2006.

I do know they are in breach of the sale of goods act 1979 and he can request a refund which they have denied. But what are the laws for selling out of date goods? What law is this in breach of? Is it Illegal to sell out of date products when they say its fresh goods and of top quality? (That’s not as described and puts them in breach of the sales of good acts but wondering if there is an out of date goods law)

If it was online then by law you automatically have a "cooling off" period, in which to return the goods and get a refund.

The 3 week delay might be a problem - I'm not sure when there is a delay in delivering goods if the cooling off period is extended accordingly.

My advice would be to pay a visit to the CAB and see what they have to say.

Will try and get him to give them a call, doubt he will have time to visit them as hes at work all day.

The cooling off period is 7 days from when you receive the goods so it doesn't matter that there was a delay.
