Apple and its U.S. wireless partner AT&T are being sued for selling too many iPhones by a customer who says the high-speed phone network has been "overloaded" and unable to deliver promised performance.
The iPhone 3G, designed to work with AT&T's faster third-generation network, switches over to slower networks because of the "high volume of 3G iPhones sold," according to an Aug. 29 complaint filed in San Diego. Plaintiff William J. Gillis Jr. is seeking class-action, or group, status on behalf of other users. Apple sold 1 million iPhone 3G handsets in the first three days after the device went on sale July 11. The company says the new model is twice as fast as the original Web-surfing handset, first offered in June 2007. Apple released a software update earlier this month to improve network connections after some customers complained about dropped calls and sound quality. AT&T is Apple's exclusive partner in the U.S. "Apple and AT&T have misrepresented to the public the speed, strength and performance of the 3G-bandwidth network," according to the 14-page complaint. Apple doesn't comment on pending litigation, said spokeswoman Susan Lundgren. AT&T spokesman Fletcher Cook wasn't available to comment. Apple was sued last month by another customer who complained of dropped calls and slower-than-promised download speeds over the Internet. Wow... if anything APPLE has the worst business practices... they sell you a macbook with intel cpu/chipset/gfx for sometimes double the PC Laptops only because its a friggin mac with with their OS and its "white" or "silver". Apple can go to hell. I'm ready to sell my iPhone already its been a let down in many ways. It locks up often, the browser crashes when I need it most, battery life is unacceptable/abysmal, and its not a powerful phone like the other smart/symbian phones. Too often do I get the "no sim card" message..... Sometimes when it locks up it takes up to 5min for it to restart.
And no my phone is not defective... It's my 2nd replacement... The GPS stinks on it... The only thing the phone offers.... is that wonderful screen... large, bright, and so pretty. If it wasn't for the screen... I never would have bought this pos. |

I don't like their business ideas; they buy a lot of companies with great ideas then use them only if they give them more money and shut them down of course so no one else can be richer and bigger in the computer world. This may sound a little paranoid but I dont like it, just the way. |

Apple should not be part of that lawsuit. They did nothing wrong. AT&T is the one to blame. Apple had nothing to do with overselling AT&T's network other than make a popular device. I think it may be time for AT&T to improve their infrastructure.
I've seen it said it many articles, the worst thing about the iPhone is AT&T. I totally agree. If there were another GSM carrier in my area my phone would be jailbroken. I'm ready to sell my iPhone already its been a let down in many ways. It locks up often, the browser crashes when I need it most, battery life is unacceptable/abysmal, and its not a powerful phone like the other smart/symbian phones. Too often do I get the "no sim card" message..... Sometimes when it locks up it takes up to 5min for it to restart. |

I don't like their business ideas; they buy a lot of companies with great ideas then use them only if they give them more money and shut them down of course so no one else can be richer and bigger in the computer world. This may sound a little paranoid but I dont like it, just the way. |

I just picked up an iPhone yesterday. Mostly out of necessity.. I really wanted to wait a little longer and see how the android phone and new blackberry were gonna compare? But my old out of contract phone was dropping or not even connecting calls all the time. It was getting pretty impossible! At first I thought it was AT&T messing with me in order to get me to upgrade and renew, but my wife wasn't having any problems with her phone. So it was either stick with AT&T and get an iphone time or switch carriers. I couldn't really wait any longer.
So with the little time I've had my iPhone I must say its great! As for the 3G? Not impressed, so slow its hardly worth using or surfing the web. However at home on my wireless network its very snappy. |

To me the most amusing thing about it is that ATT forces you to buy the full unlimited data plan, which is higher with the 3G iPhone. also i think apple is responsible to a certain extent. im sure they knew that their G3 phone would sell like hot cakes and that they should have partnered with a company that would be able to take on that demand with ease. im sure they knew full well before signing on the dotted line that at a certain point AT&T's network would start to suffer and just wouldn't cut it anymore. |
