Seriously... apple is just crazy trying to trademark their apple logo, after all it is a piece of fruit. I have never thought about the Woolies logo looking like apple computers.

Are "Apple" so deluded and so far up their own arses that they think they own this fruit.
As far as I am aware - it was created by Nature or God, and thus belongs to them


Woolies logo doesn't look the same, and sure as hell doesn't confuse or remind me of the "Apple" company franchise.

I hope they lose this case, lose some money and make Woolies richer.


Apple can p!ss off on this one.

Imagine Apple being as large as Microsoft. I think they would be more evil. Considering they are all about protecting their IP and their perceptions of Apple products. The way they control their apps store for iphone.

Apple just seems like a company that likes controlling people. While MS does it to a degree, I don't think they are nearly as bad.

That's EXACTLY what I thought when I first saw it, and I see it a lot when I go to Wollies. I never knew it was meant to be an apple, I thought maybe a weird looking green flower at most[rofl]. So it's an apple hmm[stupid]

I don't see Apple winning this, and if they do I will be quite surprised.

Don't be so ridiculous. They are trying to TRADEMARK their logo. A logo is something that is used to identify a brand. If these logos were faxed or printed in single / solid colour they would look quite similar. I'm not saying that it's a particularly fair claim but woolworths designers should have investigated properly before producing this logo. We've just created a logo for a major brand and had to change it several times to avoid any kind of conflict, and even then we've received a letter from a small brand claiming copyright infringement.

You're being completely narrow minded. Convert the woolworths logo to a single solid colour and you will see that the shape is quite similar. Unfortunately, the precendent was set in 2006 when a judge ruled in favour of Apple against Apple Corps.

I don't know much about this field (and I suspect you know even less), but I do know that the field of trademark law is a bizarre and complicated arena that is best left to the experts.

If you make both these logos a solid colour they are completely different. One of them is a 'W' shape and the other is shaped like an apple. The only slight resemblence they have is that they both have a small 'leaf' emblem above them. The angles, corner curvature and size ratio even of that element is totally different however. If Apple wins this I'll be extremely surprised.

The whole case will rest on whether or not the logos can be mistaken for each other, not whether all the pixels match. Hopefully they won't win though as it will make logo design even more difficult.

You would have expected more from me than my professional opinion? Not sure what else I can give. I've been designing identities for 10 years and have designed logos for huge multimational companies. I know what merits trademark copyright infringement and in my opinion these logos are sufficiently (and blatantly) different enough that it's going to be very difficult for Apple to protest.

It's far more tenuous than say Ferrari and Lloyds TSB's identities. What exactly did you mean you'd expect better from me? I'm right.

that is only part of the case though, the judge will have to determine if anyone is going to walk into Woolworths for the sole intention of buying an Apple product, other things like do Woolworths sell their own Apple competing products.
Clearly if you're that easily mistakened I think one shouldn't leave the house and use plastic cutlery incase they use a kitchen knife as a soup spoon.

Apple are acting the big money bully in this situation IMO.

Do you mean Brand Recognition in the way that everyone who's commented so far has seen the W and not an apple first and foremost? Let alone The Apple apple.

You are an idiot... obviously Dangermoose is correct. Don't you see it? If you take the portion of the Woolworths icon that is white and make it into a solid silver apple... then took a bite out of it and made the apple leaf silver... then you can see the similarities....


Also I think the honda accord coupe is a replica of the bmw m6 and should be sued for it.. If you change the rims, head lights, tail lights, add the kidney bean, lower the stance, add an onboard computer, change the hood, and change the trunk of the honda to the bmw... then you can see the similarities

Look you miserable idiot, I didn't say I agreed with it. I said there is enough of an issue for Apple's high priced lawyers to want to fight it. If you can't read don't try and abuse me for it.
